PARTICIPANT WAIVER & HEALTH DECLARATION
This is an agreement between Aqtiveco Performance Limited, trading as Aqtive Co (“the Studio”), and the participant named below. By signing, I confirm that I have read, understood, and agreed to the following:
1. Health declaration.
I am in good physical health and not aware of any condition, illness, or injury that would make my participation unsafe, and I will consult a doctor if I have any doubt about my fitness to participate. I will inform my instructor before each class of any injury, illness, recent surgery, pregnancy, or physical limitation.
2. Assumption of risk.
Participation in Studio classes (Hot Pilates, Mat Pilates, Hot Yoga, Yoga, and Strength Training) and the use of Studio equipment involve inherent risks, including injury, strain, aggravation of pre-existing conditions, and, in heated classes, dehydration or heat-related illness. I voluntarily choose to participate and accept these risks.
3. Release of liability.
To the fullest extent permitted by Kenyan law, I release and discharge Aqtiveco Performance Limited, its owners, directors, instructors, employees, and contractors from any claims, losses, or damages arising from my participation in any Studio class or activity, or from my use of Studio equipment or facilities.
4. Medical emergency.
In the event of an emergency, I authorise the Studio to seek emergency medical assistance on my behalf.
5. Studio conduct.
I will follow the instructions of Studio instructors and staff, respect the Studio space and other participants, not attend class if I am unwell or contagious, and hydrate adequately before heated classes. The Studio may ask me to modify or stop an exercise, or to leave the premises, if I pose a risk to myself or others.
6. Declaration.
I am 18 years of age or older, I have read this waiver in full, and I am signing voluntarily. This waiver applies to all classes I attend at the Studio and is governed by the laws of Kenya.
